Terms and Conditions

Take your time to read through the terms and conditions thoroughly before signing up to a pass, pack, single class, workshop, event, training or membership at Kynd Studio. When making a purchase and booking into any services or classes we offer, you agree to the terms and conditions as outlined on the Kynd Studio website kyndstudio.com.au and through our app (Kynd Studio) and booking software.

    • New clients/students are eligible to purchase our Introductory Offer (“Intro Offer”) and may purchase it once. Our Intro Offer may change. If you have previously purchased an Intro Offer with us and want to access it again because it has changed, you will not be able to. You may not create a new account using new personal information including email or contact number to purchase a second Intro Offer. Clients found purchasing more than one Intro Offer will be suspended. Our Intro Offer is non-refundable and non-transferable between clients. It has no expiry, however once activated the Intro Offer is valid for 14 or 28 days consecutively (depending on available promotion) with no pause or extension available. The Intro Offer will activate from the time of your first booking. This means if you book and then cancel your booking, your Intro Offer is activated and you will not be able to book a class earlier than the initially booken class day/time as this is when your offer activated.

    • All casual classes are valid for 3 months from activation unless otherwise stated in the promotional terms. All 10 class packs are valid for 3 months from date of activation (ensure you book your classes in chronological order) unless otherwise state in the promotional terms. All monthly passes are valid for 30 days from date of activation (ensure you book your classes in chronological order). All promotional offers, packs and passes have strict terms and expiries attached - make sure you understand the nature of the pass before purchasing. They are non-refundable and non-transferable between clients. No extension will be permitted except for unforeseen injury or medical reasons. Extensions due to medical reasons must be requested before the expiry date, and a current medical certificate will be required via email.

    • Sessions are not transferrable to another individual and cannot be used by another person. If someone other than the person booked into the class arrives to use the session, they will be asked to create an account and purchase their own sessions.

    • Class bookings are not essential, but are required to secure your spot in class. If you are not booked in, you may miss a spot in a full class. If you are not booked in and unforeseen circumstances arise such as a class cancellation due to teacher unavailability or emergency, you will not be on our list to contact to make alternative arrangements. Bookings are to be made through your account via Kynd Studio app, or directly through our website. We do not accept bookings for studio classes via email, DM, text or in-app message. Private and corporate sessions must be booked via email at hello@kyndstudio.com.a

    • Payment must be made prior to booking and attending class. To book into a class you must have pre-purchased sessions in your account or pay at the time of booking in at the studio.

    • Drop ins. If you walk in, provided there is a spot available in class, you will be asked to create an account, pay for your class or pass in full before class commences and agree to our terms and conditions of entry.

    • Changes to your schedule via text message, email, voicemails, phone calls, or social media will not be accepted. Please do not hesitate to ask for assistance if unsure on how to cancel or reschedule your class prior to class commencement.

    • Kynd Studio reserves the right to cancel classes with minimum numbers booked in. You will be contacted via text 2 or more hours prior to the start of class should it need to be cancelled and your session returned.

    • Changes to your schedule via text message, voicemails, phone calls or social media will not be accepted. Please do not hesitate to ask for assistance if unsure on how to cancel or reschedule your class.

    • To minimise disruption and ensure safety, if you are 5 minutes or more late to class, you may not be permitted entry or asked to wait to enter (for yoga, sound, breathe classes). If you are new to Kynd Studio and arrive late to class, it is at the Teacher’s discretion to prohibit entry at any point. Empty spots at the start of class will be given to walk-ins an pre-bookings will not be prioritised if late.

    • Arriving after the start of class is considered late. If you’re late, you may forfeit the session and may be considered a No Show. It is your responsibility to ensure you are checked into class that you were late to.

    • Owners and/or teachers reserve the right to restrict clients to a particular class type for safety reasons; and owners and/or teachers reserve the right to turn clients away if they do not have the correct medical clearance.

    • Cancellations made -4 hours prior to class start time will forfeit that session. No-shows and absences will forfeit that session. KYND MEMBERS will incur a $10 No Show fee for all classes they’re marked absent for and a $5 Late Cancel fee for all classes canceled within 4 hours of class. A Late Cancel 30 minutes before class is considered a No Show. CLASS PACK/PASS HOLDERS AND INTRO OFFER HOLDERS will incur a $20 No Show fee for all classes they’re marked absent for and a $10 Late Cancel fee for all classes canceled within 4 hours of class. ALL MEMBERS will receive 1 fee waiver per calendar month.

    • If a class you want is full, you can sign up for the waitlist. If a place becomes available, you will receive either an email or text to let you know you are on the class list. If you do not respond to the text/email, we assume you’re coming and the system will automatically add you in. Treat a your waitlisted class as a booked class and if your schedule changes, cancel yourself from the waitlist to ensure you don’t get a surprise last minute spot if you’re no longer interested in attending. Remove yourself from a waitlist class if you know you cannot attend so the next person on the list moves up.

    • Gift cards can be used for classes and product at Kynd Studio. They are not redeemable for cash and are non transferable. Kynd Studio does not offer refunds, transfers, suspensions or extensions on Gift Cards for change of mind, injury, illness, change of address or any other reason. All purchases are final and in accordance with the Australian Competition and Consumer Commission.

    • Students and Concession Card holders are eligible for a 10% discount on all pricing options except for introductory offers. Proof via photo of Concession Card or Student card must be emailed to hello@kyndstudio.com.au. Access to the discount expires at the end of each year and must been renewed if still applicable.

    • Please keep mobile phones them switched off or on silent mode if brought into the studio. In rare circumstances you are awaiting a call, please notify the Teacher before the start of class.

    • Heartbeat High is in no way responsible for the safekeeping of your personal belongings while you attend class. Heartbeat High does not assume responsibility for any lost or stolen personal property.‍

    • You understand that classes may be physically strenuous and you voluntarily participate in them with full knowledge that there is a risk of personal injury or death.‍

    • Upon purchase, sign up, account creation, entry and access to Kynd Studio, you agree to the Terms & Conditions outlined on the website, via our app and booking software.

    • CANCEL A CLASS. We have a very lenient 4 hour cancellation policy to allow as many people to attend classes as possible. Simply cancel your class the same way that you booked (through our app or via the website).

    • YOUR BOOKINGS ARE YOUR RESPONSIBILITY. Please do not book classes you don't intend on attending. We often have waitlisted classes and other members miss out when you don't show up. It also disrupts our planning and class flow if we think you're coming but you don't show up.

    • HOW TO CANCEL. We cannot accept cancellations via email, text, the app or social media. Cancellations made more than 4 hours before the class starts will get the session or credit back. Late cancellations made less than 4 hours before class starts will forfeit the session. No-shows and absences will be charged.

    • If you are cancelling your first class booked on a new pass or pack, be mindful that your pass or pack will be active from te date of this first class. You will not be able to book any classes earlier than the first class booked on a pass.

    • WAITLIST. Our waitlist ensures that everybody gets a chance to access classes. Adding yourself to the waitlist means that you are committed to coming to that class. If something comes up, please cancel from the waitlist as you would cancel out of a class. You will be notified (by email, text or app, depending on your communication preferences) when you have been moved into the class. You can accept your spot. If you do not do anything, we assume that you are coming.

    • 2 Class/Week Memberships

    All Memberships operate on a 7 or 14 day autopay schedule from the credit card stored in momence (a secure system).

    Memberships will continue with scheduled autopays unless Kynd Studiois notified of a termination request in writing (see Termination Policy below).

    Memberships may be subject to price increase and will be notified of one in writing 4 weeks prior to any change.

    New Memberships are subject to a minimum six week lock-in contract after which, cancellation can be arranged anytime in writing (see Termination Policy below). Memberships can be updaded/downgraded within the 6 week minimum contract.

    Unlimited Memberships will incur a $10 No Show fee for all classes they’re marked absent for and a $5 Late Cancel fee for all classes cancelled within 4 hours of class. A Late Cancel 30 minutes before class is considered a No Show. All Members will receive 1 fee waiver per calendar month.

    2 Class / Week Members can purchase additional sessions at $20 per class. This is the responsibility of the member to arrange prior to taking class via purchasing individual sessions. Additional sessions will be valid for 7 days from purchase. If during the weekly cycle, an extra session is taken and shows as unpaid or owing, $20 will automatically be charged to the card on file per session booked, regardless of late cancel or no show.

    Failed Membership payments will incur a $10 fee for every day the payment fails to process. This fee will be processed as a debit on the clients momence account which will be processed with the Membership payment.

    On the third day of payment failing to process all booked classes will be cancelled and the Membership will be placed on hold. The failed Membership charge, plus any outstanding fees will be processed as a debit on the clients momence account, to be balanced within 7 days or the account will be terminated.

    MEMBERSHIP SUSPENSIONS

    • At least 2 weeks written notice is required for membership pauses suspensions. This ensures that the correct measures are put in place to cease credit card payments that are scheduled for the given period.

    • Suspensions are unlimited, however we cannot place more than 1 suspension on your account at one time. You will need to organise the first suspension and then contact us to arrange the second after the initial suspension has ended. This is your responsibility.     MEMBERSHIP TERMINATION POLICY

    • Kynd Studio requires at least 2 weeks written notice to terminate membership. Please email request to hello@kyndstudio.com.au

    • New Memberships are subject to a minimum six week lock-in contract after which termination can be arranged anytime in writing.

    • In the case of long term or permanent injury or illness that prevents the use of our services, immediate membership termination will be permitted. Termination will take effect from the date we receive written confirmation from a medical doctor.

    • Kynd Studio may terminate a membership without notice for inappropriate, offensive or illegal behaviour, as determined by us, which occurs on our premises or is directed at our staff or other members.
